Article 1 - Applicability

1. These are the terms and conditions (‘Terms and Conditions’) of Webbags B.V. (‘The Chesterfield Brand’). These Terms and Conditions apply to all orders placed via The Chesterfield Brand website.

2. By placing an order, you expressly agree to the applicability of these General Terms and Conditions to the order you have placed and declare that you have taken note of their content.

Article 3 - Agreement, price and payment

1. The agreement is concluded when you place an order via the website and The Chesterfield Brand has sent you a confirmation of your order by email.

2. The Chesterfield Brand reserves the right not to accept your order if:

- The information you have provided is incorrect or incomplete and The Chesterfield Brand has doubts about the accuracy of this information;

- You have not fulfilled a previous payment obligation;

- You have not accepted the delivery of a previous order and/or you have not collected a previous order;

- The delivery address you have provided is in a country where The Chesterfield Brand does not deliver.

The Chesterfield Brand will inform you as soon as possible if it does not accept your order.

3. The price stated on the website at the time of payment is the total price of all products, including shipping costs and applicable taxes.

4. To pay for your order, you can choose from one of the payment options offered by The Chesterfield Brand.

5. Orders delivered outside the European Union may be subject to additional surcharges and/or taxes. These surcharges and/or taxes are expressly not included in the total price stated in paragraph 2 of this article. Any additional costs based on these surcharges and/or taxes are at your expense and risk.

6. The Chesterfield Brand cannot be held to an offer on its website if you can reasonably understand that the offer, or part thereof, contains a clear error or typo, such as an unusually low price. We request that you contact The Chesterfield Brand if you have any doubts about the accuracy of an offer.

Article 4 - Delivery

1. The Chesterfield Brand will do its utmost to process and deliver your order as soon as possible after receipt of payment. A delivery time indicated by The Chesterfield Brand is indicative. The delivery times indicated on The Chesterfield Brand's website are based on circumstances known to The Chesterfield Brand at the time of concluding the agreement and may be subject to change due to external factors, such as the chosen payment method, the method of transport and internal availability. Delivery times are also subject to change if you make changes to your order.

2. You are obliged to do everything that can reasonably be expected of you to enable The Chesterfield Brand to deliver your order on time. If you do not cooperate as described in this Article 4, paragraph 2, The Chesterfield Brand reserves the right not to deliver the products.

3. Your order will be delivered to the delivery address or collection point you specified on The Chesterfield Brand website.

4. Ownership of the ordered products will transfer to you once The Chesterfield Brand has received your payment for the products you have ordered.

5. The Chesterfield Brand will endeavour to deliver the products you have ordered complete and in good condition. If the delivered products are incomplete or damaged, please contact us as soon as possible.

Article 5 - Accurate representation & Lifespan

1. The Chesterfield Brand will do its utmost to display the products as accurately as possible on its website. If you believe that the product you have ordered does not correspond to the display on the website at the time the product is ordered, you may exercise your right of withdrawal. Article 6 of these General Terms and Conditions describes how you can exercise your right of withdrawal.

2. The lifespan of the products offered by The Chesterfield Brand on its website depends on the material of the product and the manner and intensity with which you use the product. To ensure that the products retain their longest lifespan and highest quality, it is important to follow the instructions on our website.

Article 6 - Cooling-off period & Right of withdrawal

You have the right to withdraw from this agreement within 30 days without giving any reason. The withdrawal period expires 30 days after the day on which you, or a third party designated by you who is not the carrier, took physical possession of the last goods.

To exercise your right of withdrawal, you must inform us [The Chesterfield Brand, Amerikaweg 24, 9407TK Assen, customersercvice@chesterfieldbags.com, +31 50 763 08 89] of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post, fax or e-mail). You may use the attached model withdrawal form, but this is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

1. If you are not satisfied with the product(s) you have ordered, you may terminate the agreement within a cooling-off period of thirty (30) days after receipt of the product in question without giving any reason (right of withdrawal).

2. The cooling-off period begins on the day after you receive the product, or on the day that a third party designated by you (not the carrier) receives the product.

3. If you wish to exercise your right of withdrawal, you can also follow the instructions provided by The Chesterfield Brand, which can be found on the website https://www.chesterfieldbags.com/pages/returns. We request that you return the product or products as soon as possible and in any case within thirty (30) days of informing us that you wish to return the products. The product or products can be returned to the address for returning products mentioned in Article 2.

4. Upon receipt, The Chesterfield Brand will inspect the product(s) to determine whether you are eligible for a refund.

5. If a product is eligible for a refund, The Chesterfield Brand will refund the amount paid for the product to the bank account number you used within five (5) days of receiving the product in question.

6. We will bear the shipping costs for returning the goods. An exception to this is when the customer returns an order to us on their own initiative without using our return procedure. In this case, the costs will always be borne by the customer.

7. Products that we have produced especially for you or that we have customised at your request are not eligible for a refund and cannot be returned. The same applies to sealed products that are not suitable for return for reasons of health protection or hygiene and whose seal has been broken after delivery.

8. We charge £4.95 for processing a return. The return costs will be deducted from the value of the return shipment. Gift wrapping will not be credited.

Article 8 - Complaints procedure

1. We do our utmost to ensure that the ordering and delivery process runs smoothly. If you do have a complaint, please contact us using the contact details provided in Article 2 of the General Terms and Conditions.

2. We aim to resolve your complaint as quickly as possible.

Article 9 - Applicable law & competent court

1. These General Terms and Conditions and the agreement(s) concluded between The Chesterfield Brand and you are governed by Dutch law. The applicability of the United Nations Convention on Contracts for the International Sale of Goods is excluded.

2. The competent court in Groningen has exclusive jurisdiction if a dispute cannot be resolved amicably.

Article 10 - Changes to the General Terms and Conditions

1. The Chesterfield Brand may amend these General Terms and Conditions at any time. Amendments to the General Terms and Conditions shall only take effect once the amended version has been published on The Chesterfield Brand's website. We expect you to consult the most recent version of the General Terms and Conditions when purchasing products on the website.

Additional General Terms and Conditions

Article 1 - General Terms and Conditions for Competitions The Chesterfield Brand

These General Terms and Conditions for Competitions of The Chesterfield Brand (hereinafter: “General Terms and Conditions for Competitions”) apply to the competitions on the chesterfieldbags.com website and the social media channels of @chesterfieldbags. By participating in these competitions, the participant agrees to the following General Terms and Conditions for Competitions.

1.1 Participation is free of charge and without obligation to purchase.

1.2 By participating, the participant agrees to these terms and conditions.

1.3 You participate in the promotion if you have responded to @chesterfieldbags social media or, if applicable, have completed a participation form.

1.4 To participate in a promotion, you must be at least 16 years of age; participants younger than 16 years of age declare that they have obtained permission from (a) parent(s) to participate in the competition.

1.5 Employees of Makorian BV are excluded from participating in promotions.

1.6 The duration of the promotion and the time of announcement of the winner(s) will be stated in the post or on the entry form.

1.7 Makorian BV is in no way liable for damage resulting from participation in the promotion, nor for technical malfunctions, defects or delays in connection with participation in the promotion or the selection of the winner.

1.8 Makorian BV is free to change the terms and conditions of the promotion or to terminate the promotion without giving reasons.

1.9 Participants' personal data will not be disclosed or shared with third parties without consultation, unless permission has been granted.

1.10 Participants' personal data may be used internally to send newsletters from The Chesterfield Brand, if permission has been given for this.

1.11 The winner of a promotion will be chosen by means of an impartial draw.

1.12 The winner of a promotion will be notified personally via the social media channels on which the promotion took place. If an email address has been provided, the winner will be notified by email.

1.13 If the winner does not respond within two weeks of the announcement, a new winner will be selected.

1.14 Makorian BV is authorised to disqualify persons suspected of illegal participation or fraud.

1.15 Participants who have not won a prize will not be notified.

1.16 The prize is not transferable, exchangeable or redeemable for cash or other products or services.

1.17 All actions are governed by Dutch law.

1.18 If one or more provisions of the General Terms and Conditions for Competitions are void or invalid, this shall not affect the validity of the other provisions of the General Terms and Conditions for Competitions.

Article 2 - Discount codes and coupons

2.1 Discount vouchers (vouchers that are not for sale but are distributed as part of advertising campaigns with a specific period of validity) are only valid in the specified online shop during the specified period and can only be redeemed once during an order process.

2.2 The value of the goods must be at least equal to the amount of the voucher. For administrative reasons, it is not possible to refund the remaining balance.

2.3 Vouchers can only be redeemed before completing the order process. Subsequent settlement is not possible. The credit balance of a voucher will not be paid out in cash and no interest will be paid on it.

2.4 Multiple vouchers cannot be combined.

2.5 If the credit balance of a voucher is not sufficient for the order, the difference can be paid using the payment options offered.

2.6 The discount voucher will not be refunded if all or part of the goods are returned, insofar as the discount voucher was issued as part of an advertising campaign and no payment was made for it.

2.7 If you have used a voucher for your purchase, we reserve the right to charge you the original price of the retained goods if, as a result of your cancellation, the total value of the order falls below the respective value of the voucher.
